    as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity/telephone/internet service.

DISPUTES. Any claims asserted against FFL123 by any Viewer, person, or entity shall be submitted to confidential arbitration in SiouxFalls, South Dakota. Arbitration under this Agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may beentered as a judgment in any court of competent jurisdiction. To the full estextent permittedby applicable law, no arbitration under this Agreement shall bejoined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise. Subject to the last sentence of this paragraph, in any such arbitration, the parties shall be responsible for their own costs, expenses, and attorney’sfees. In the event that this arbitration provision is unenforceable, any litigation regarding this Agreement or any transaction between any Viewer, personorentity and FFL123 shall be brought in the state or federal courts located in Minnehaha County, South Dakota, and every Viewer, person, or entity here by agrees and submits to such jurisdiction and venue as exclusive and proper. In the event FFL123 is successful in the arbitration or any litigation, it shall be awarded its reasonable costs, expenses and attorney fees.

16. TITLES. The section titles in the Agreement are for convenience only and have no legal or contractual effect.

17. GOVERNING LAW. This Agreement and the relationship between Viewer and FFL123 shall be governed by the laws of the State of South Dakota, without regard to its conflict of law provisions.

18. ENTIRE AGREEMENT. This Agreement constitutes the entire agreement between Viewer and FFL123, except for those Viewers who become or are Customers; provided that Customers are subject to additional terms and conditions for the use of products/services purchased fromFFL123.

19. DEFINITIONS.

  • a. “Agreement” shall mean these Viewer Terms and Conditions.
  • b. “Customer” includes any individual or entity that purchases any product or service from FFL123, or any individual or entity that emails Us any questions. Customers are Viewers for purposes of this Agreement.
  • c. “FFL123” shall me an BMADDOXENTERPRISES,LLC, South Dakota Silencer,FFL123.com, and all other business subsidiaries, entities, and websites owned or operated by BMADDOX ENTERPRISES, LLC.
  • d. “FFL123 Marks” shall have the meaning ascribedtoit in Section13(c).
  • e. “Our” shall mean FFL123.
  • f. “Us” shallmean FFL123.
  • g. “Viewer” is any individual or entity that views, receives, prints, distributes, otherwise uses/views the contents of this Website whether in electronic or printed form, orotherwise interacts with FFL123.
  • h. “We” shall mean FFL123.
  • i. “Website” shall include any information contained upon
    www.ffl123.com, any website that mirrors the content of
    www.ffl123.com, or any website owned or operated by FFL123.
